1.1 "Agreement" means these Terms and Conditions.
1.2 "Company" means the entity (4Writers.net) that involves the Writer into cooperation according to and as defined by the terms laid out in this agreement.
1.3 "Writer" - the person, who has agreed to work with the Company on a freelance basis under the Company's terms as laid out in this agreement.
1.4 "Customer" - the person who places an Order with the Company to obtain the Product according to his or her requirements and pays for that service.
1.5 "Product" - a document in an electronic format that is the final result of order processing.
1.6 "Support Department" or "Support Team" signifies the part of the Company infrastructure with the mission to support the cooperation and smooth work process of the Writer.
1.7 "Usability" indicates the state of the Product that defines the compliance of the Product with the terms and requirements of this agreement.
1.8 "Termination of account" means the discontinuation of services of and to the Writer and any further cooperation (i.e. deactivation of account).
1.9 "Account" means electronic record of all Orders processed by the Writer, communication, payments, and personal information about the Writer such as full name, address, payment details etc.
1.10 "Salary details" is the amount of earnings pending to be paid to the Writer for completed work.
1.11 "Message" is a unit of the Messaging system; information posted by the sender for a recipient.
1.12 "E-mails" - are a method of creating, transmitting, or storing primarily text-based human communication with digital communication systems.
1.13 "Messaging system" is an online communication tool that is available through your Account on the website. It is located in the section called "Messages" and is used for communication between the Writer, the Customer and Support.
1.14 "Reachable" means that the Writer will be available for both the Customer and Company by phones (landline or cellular) or the Internet (Messaging system or Emails) at all times while they are working on the Order.
1.15 "Responsive" means that the writer can provide the Company and the Customer with the required or requested information while processing the Order.
1.16 "Order" means an electronic request of a paid service from the Customer for a particular Product and/or service.
1.17 “Financial Department” is a unit in the Company infrastructure that manages financial operations and is responsible for billing and payments.
1.18 “Payment Method” is the money transfer service or system that is used by the Company for sending earnings or finical compensation to Writers.
1.19 “Beneficiary Info” - information that sender should submit to his/her account to receive the Earnings through their desired Payment Method.
1.20 “Payout Dates” - dates when the Company sends Earnings to Writers via one of the selected Payment Methods.
2. Terms of Agreement
This engagement shall commence upon the execution of this Agreement and shall continue in full force and effect upon and up to the closure or termination of the account.
3. Subject of the Agreement
This Agreement is made and entered into on the (day of account registration) by (writer name) and is signed between the Writer and the Company, an online writing company providing research and writing services. This agreement herein entitles the Writer to provide writing and research services to the Customers.
4. Product and Service requirements
All products should be delivered in complete compliance with academic writing standards, customer’s requirements, and Company’s policies.
4.1 Academic writing standards.
4.1.1 Description. The Product should be written according to the common academic writing standards that include but are not limited to the following:
a) Layout and organization (referencing style, standard formatting, word limit).
b) Grammatical resource (accurate use of grammatical rules, accurate spelling, punctuation, sentence structure).
c) Lexical resource (word choice, effective arrangement of words, language flow).
d) Diction management (order specifics (tables, graphs, charts etc.), logical arrangement, presentation of own views and ideas, relevance of utterances, linking ability).
e) Plagiarism – all papers must be plagiarism-free.
Assessment is done manually by Editorial and Quality Control Department after a paper is submitted or after any complaint from the Customer is received. Assessment takes place after Editor's check.
Breach of rules laid in the section 4 of this Agreement will result in monetary penalties, temporary blocking of writer’s account, and/or termination of writer’s account due to following reasons:
4.3.1 Product is recognized as usable but classified as “Low Quality” - the fine is applied in the amount of up to 50% of Writer’s earnings for the low quality Order.
4.3.2 Product is recognized as not usable and classified as "Unacceptable Quality" – a fine in the amount of up to 100% of Writer’s earnings for the Order is applied. In addition to the sanction, the Writer is not reimbursed for that particular Order.
4.3.3 Product contains plagiarism - the fine is classified as "Plagiarism" and applied in the amount of up to 100% of Writer’s earnings for the plagiarized Order. In addition to the sanction, the Writer might not be reimbursed for the particular Order.
4.3.4 Any instance classified as "Plagiarism" may lead to the termination of Writer's account and his/her cooperation with the Company in compliance to this Agreement and Company’s policy. For more details, see the section "Termination of Account."
4.3.5 If the Writer was neither reachable nor responsive throughout the Order processing, the fine is classified as "Neglect" and will be applied in amount of up to 100% of Writer’s earnings for that Order. In addition to the sanction, the Writer is not reimbursed for that particular Order that has been classified as neglect.
The Writer has a right to dispute the sanction within 3 (three) business days from the moment it was applied. The reasoning must be acceptable and placed in the messaging system for consideration. The investigation conducted by the Support and/or Quality Control Department usually takes about 7 (seven) business days from the time the dispute was submitted.
4.5 Compliance with the Customer's requirements
4.5.1 Product should be written and delivered according to the specific requirements of the Customer that include:
4.5.2 Topic and Order description, paper type, number of pages, referencing style, number of sources, academic level.
4.5.3 Deadline. All papers should be delivered within the indicated timeframe.
4.5.4 Additional files are provided to guide your writing and help to satisfy customer’s requirements. Please, use them accordingly.
4.5.5 Additional requirements via emails, files and/or messages. Sometimes, customers may provide valuable information or deeper clarification of instructions in messages. Thus, do not forget to read all messages received from Customer and Support.
4.6 Compliance with requirements of the Company
4.6.1 The Writer should follow all requirements of the Company that include:
4.6.2 Timely submission of taken Orders.
4.6.3 Timely responding to all messages and emails, availability for communication over the phone.
4.6.4 Non-disclosure of Writer’s personal information, contact and/or billing information, computer usernames, nicknames, online contacts, any information related to the Account of the Writer or the working process of the Company under any (real or fake) identities.
4.6.5 Rendering of any services must be executed only under ONE username with the correct and up to date personal information of the Writer. Working under multiple or fake accounts (user names) is strictly prohibited.
4.6.6 Submission of Product according to the following format:
f) Standard A4 pages.
g) Margins - 1 inch (2,54 cm) on each side.
h) Format - double spaced or single spaced as requested by Customer.
i) Font - 12 pt. Times New Roman. Use the same font throughout the entire paper, except cases described in point 9 below.
j) Word count – minimum 300 words per double-spaced page and 600 words per single-spaced page.
k) Text has to be left-aligned, no justification is used.
l) Paragraphs - no additional spacing or additional empty lines between paragraphs.
m) Page Headers must be formatted in accordance with the required citation style (in APA and MLA Styles, place the Page Header at the top right-hand corner of every page. In APA Style, there should be no number on the title page, and subsequent pages should have page numbers that correspond to their actual number (i.e. 2 for second page, etc.)). In APA Style, include the title and the page number; in MLA Style, include the last name of the author of the paper and the page number; in Chicago/Turabian Style - no Page Header on the first page, other pages should contain author’s last name and page number, starting from 1 on the second page, not 2).
n) Footnotes/Endnotes - always use in Chicago/Turabian Style, 12 pt Times New Roman font, single spacing (even for double-spaced papers).
o) Graphics - you are encouraged to use visuals in your writing (graphics, images, photos, charts), if applicable. Graphics are not counted to the paper volume.
p) File name - before you upload the paper, name the file by the Order ID and the Order topic: '6052109_Shakespeare.doc', where 6052109 is the Order ID (number) and Shakespeare is the Order topic (title).
q) Properties - go to 'File' > 'Properties' and click on 'Summary' tab in your Word application; delete any information about 'Author', 'Company' or any other field. Leave the title of the paper only.
r) Bibliography - include a Bibliography page in every paper and format it, as well as in-text citations, according to a required academic style. Note: in APA Style, it is 'References'; in MLA Style, it is 'Works Cited'; in Chicago/Turabian, it is 'Bibliography'. Note: Bibliography page is not considered as an actual text page (is not included in the word count), and it is not compensated.
4.6.7 Writer should inform the Company about any long term periods of inactivity and provide reasons or otherwise the automated system will change the account status to inactive and then to fired. All pending earnings will be processed on the regular rules and payment schedule.
4.6.8 Draft. Writers who are working on big high value orders must upload a draft of the paper if it is requested by the Quality Control Department (QCD). In addition, writers should upload the draft if the customer orders it as an additional service. The draft must be uploaded after the request from QCD prior to uploading the Product but not later than 40% of time left before the order deadline. In case the draft is of unsatisfactory quality or was not uploaded, the fine of up to 20% of writer's total earnings for the particular order will be applied. The Company also reserves the right to reassign the order to another writer in the aforementioned case.
5. Payment terms and conditions
5.1 Payment basis. Once the service has been completed and rendered to the Customer, the Writer is entitled to the Earnings for each Product delivered to the Customer that is in full conformity with Product and Service Requirements of this Agreement. The Earnings for any particular order depends on the product complexity and the deadline specified by the Customer. The Company has a monthly payout system. All orders completed from the 1st till the 30th (31st) day of one month (the final deadline of which expires by 30th (31st) date) will be paid the following month within 7 business days after the salary is calculated (which is usually on 15th-16th day of the month).
5.2 Payment Methods. The Writer has a right to choose the Payment Method that the Company uses for processing Earnings. The Payment method should be chosen according to their specific location and the availability of the Payment Method service offices. The choice includes the following:
5.2.1 Wire Transfer. To have the Earnings processed via Wire Transfer, the Writer needs to have a U.S. dollar bank account. The minimum amount possible to process by this Payment Method is 50 USD. In order to have the Earnings processed, the Writer has to choose the minimum amount and payment options offered by our Financial/Billing Department from the following:
$50 ($20 fee to be deducted)
$100 ($20 fee to be deducted)
$300 ($20fee to be deducted)
$1500 (no fee)
On average, it takes up to 7 business days for transactions to be processed. We guarantee that your salary will be sent within the specified time. The exact date you will receive your payments does not fully depend on the performance of the Billing Department. The transaction depends on several circumstances that are beyond company's control, such as local and international holidays, weekends, time zone differences and individual bank rules and policies.
5.2.2 PayPal. To have your Earnings processed via PayPal, the writer needs a PayPal account. The minimum amount is 50 USD. In order to have the Earnings processed via PayPal, the Writer needs to submit the e-mail registered with PayPal.com.
5.2.3 WebMoney. To receive earnings via WebMoney, you need to specify your WebMoney purse number.
5.3 Earnings that are less than the minimum amount will be carried over to and paid to the Writer during the next payout period, when the writer earns the minimal sum that can be transferred.
5.4 Payment processing. To have the Earnings processed, Writer needs to submit his payment details and have it verified with the Financial/Billing Department before the Payout Dates to ensure timely payment delivery. If payment details are not submitted, are incorrect or not yet verified, the Company reserves the right to postpone the payout of the Earnings until the necessary requirements are fulfilled. The Company does not bare any expenses on the writer's behalf and does not offer assistance with the 3rd party account obtainment, fees and/or maintenance of that account.
5.5 Payment details should be submitted 3-4 days prior to the payment session. The writers who are late with payment details info update/submission are paid during the following payment term.
5.6 Writers are responsible for submitting correct payment details. Failure to submit valid payment details will result in bank fees being subtracted from Writer's salary. The company reserves the right to change the payment date due to sudden/unexpected circumstances/technical difficulties. In such case, writers will be properly notified in news box on the website
6. Termination of Account
Writer’s account can be terminated due to reason of non-compliance to the established policies or violations laid out in this Agreement.
6.1 Any instance that is classified as "Plagiarism" may lead to the termination of the writers account with the Company. The account undergoes thorough quality check with Quality Control Dept.
6.2 Three or more sequential instances or 20% of any total combined instances of "Unacceptable Quality", "Noncompliance" or "Neglect" for the period of 30 days may lead to termination of the writer’s account with the Company. The Writer is reimbursed only for quality orders. The payment is processed in 3 months after the termination date.
6.3 Any issues that require a detailed investigation and analysis of any order for its compliance with requirements may have any pending earnings put on hold for 2 months.
6.4 A breach of section 4 of this Agreement (specifically, working under multiple or fake accounts (user names)) will result in the immediate termination of all accounts; that is irrevocable and final, with no reimbursements made for work completed under those fake accounts.
6.5 The Company reserves the right to terminate this Agreement "at will" with no explanation by providing an email notice within 10 working days. The writer will receive all pending reimbursements for all orders that are in full compliance with all requirements.
6.6 Disclosure of any information related to the Company, Writer’s accounts, functions, general operating process or any negative information that may potentially damage the company's reputation shall lead to the immediate termination of the writer's account with no reimbursements made.
6.7 If the writer is convicted of any violation, failure or refusal to fully comply with these Terms and Conditions or any reasonable directive of the Company, the Company reserves the right to stop cooperation with such writer and terminate his/her account at any time. The termination will take place immediately and without prior written notice to the writer who is guilty of serious misconduct of the defined provisions of this Agreement between the Company and the Writer. Upon a serious violation of these Terms and Conditions, the due balance is not processed to the Writer.
6.8 The Writer may terminate this agreement at any time by providing a written notice of 10 working days in the form of an email. Termination of the Agreement will be granted by the Company if all due Product deliveries of Writer's account are completed. Complying with the written notice and competition of any additional orders will allow a writer to maintain a positive history and may be eligible for future cooperation. All due payments are processed according to the Payment terms and conditions of this agreement. Should the said obligation of terming is not agreed by the Writer, the Due Balance is not processed to the Writer.
6.9 The Company has all technical capabilities to track sold accounts.
If a Writer shares an account with another person, he/she will be penalized. The salary will decrease by 50% from the upcoming salary payout. Usually the transfer of accounts brings numerous issues (late orders, refunds, reassignments, etc.). The penalty will be applied to one salary and a Writer may continue writing (unless he/she violates other major rules and we will be forced to terminate cooperation). If account is sold for the 2nd, 3rd, etc. time, the penalty will also be imposed.
The Writer acknowledges that during the engagement he or she will have access to and become acquainted with various trade secrets, inventions, innovations, processes, information, records, and specifications that are owned or licensed by the Company and/or used by the Company in connection with the operation of its business. These include, without limitation, the Company's business and product processes, methods, customer lists, accounts and procedures. The Writer agrees that he or she will not disclose any of the above-mentioned information directly or indirectly, or use any of the listed items in any manner, either during the term of this Agreement or at any time thereafter, except for cases required in the course of this engagement with the Company. All files, records, documents, blueprints, specifications, information, letters, notes, media lists, original artworks, notebooks, and similar items relating to the business of the Company, whether prepared by the Writer or otherwise coming into his or her possession, shall remain the exclusive property of the Company. The Writer shall not retain any copies of the foregoing items without the Company's prior written permission. Upon the expiration or earlier termination of this Agreement, or whenever requested by the Company, the Writer shall immediately deliver to the Company all such files, records, documents, specifications, information, and other items in his or her possession or under his or her control. The Writer further agrees that he or she will not disclose his or her retention as an independent contractor of the Terms of this Agreement to any person without the prior written consent of the Company and shall at all times preserve the confidential nature of his or her relationship to the Company and the services hereunder.
Any and all developments and innovations conceived by the Writer during this engagement related to the duties under this Agreement shall be the exclusive property of the Company; and the Writer hereby assigns all right, title, and interest in the same to the Company. Any and all developments and innovations conceived by the Writer prior to the term of this Agreement and utilized by him or her in rendering duties to the Company are hereby licensed to the Company for use in its operations and for an infinite duration. This license is non-exclusive, and may be assigned without the Writer's prior written approval by the Company to a wholly-owned subsidiary of the Company.
9. Changes to this Agreement
No amendment, change or modification of this Agreement shall be valid unless in writing agreed by the parties hereto.
